Terms of Service

By purchasing from Dodeca Domes, you agree to the following Terms of Service:

General Information

Tulberg LLC, operating as Dodeca Domes, is a single-member limited liability company (LLC) based in Portland, Oregon.
The buyer must be at least 18 years old to purchase products or services from Dodeca Domes.

No Refunds

Dodeca Domes sells made-to-order products. All sales are final. Once an order is placed, cancellations, returns, and refunds are at the sole discretion of Dodeca Domes.

Limited Warranty

Dodeca Domes guarantees that all physical items are free from manufacturing defects at the time of sale. This warranty covers only defects arising from the manufacturing process, such as issues with materials, welding, or fabrication. The warranty is valid for 30 days from the date of delivery. Claims for manufacturing defects made after this 30-day period are subject to the sole discretion of Dodeca Domes and may not be covered. The warranty does not cover defects resulting from misuse, improper installation, wear and tear, rust, or any modifications made to the product after it has been sold.

Use of Product

The purchase of the hubs, plans, and drawings grants the buyer a non-transferable, non-exclusive license to build one (1) geodesic dome for personal or commercial use of the completed structure.
Dodeca Domes retains all intellectual property rights to the design, including the hub design, plans, and drawings. The buyer may not reproduce, sell, publish, share, or distribute any part of the design without written consent from Dodeca Domes.

Commercial Use Restrictions in Portland, Oregon

The buyer agrees not to offer for commercial use any geodesic dome based on the purchased hubs, plans, or drawings within or advertised as being associated with Portland, Oregon, without prior written consent from Dodeca Domes. This restriction applies specifically to commercial activities, including but not limited to Airbnb rentals, other short-term rental services, and any form of rental or sale for profit.

Limitation of Liability

Dodeca Domes is not responsible for any damages, injuries, or losses that may result from the construction or use of the dome. All use of the hubs, plans, drawings, and instructions are at the buyer’s own risk.
The instructions provided are not intended as professional construction, engineering, or architectural advice. They are based on the personal experience of Joshua Tulberg, the original builder and owner of Dodeca Domes. Joshua Tulberg is not a licensed architect, engineer, or contractor.
Dodeca Domes makes no guarantees that the hubs, plans, drawings, or instructions will meet local building codes or be suitable for your specific needs or location. It is the buyer’s responsibility to ensure compliance with local laws, zoning regulations, building codes, and any other legal requirements related to the construction and use of the dome.

Indemnification

The buyer agrees to indemnify and hold harmless Dodeca Domes (Tulberg LLC), its affiliates, and any of its officers or employees from any claims, damages, or liabilities arising from the buyer’s use of the product, violation of these terms, or any other matter related to the construction or use of the dome.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Oregon, without regard to its conflict of law principles.
Any legal action or proceeding arising out of or related to these Terms of Service shall be brought exclusively in the courts located in Portland, Oregon, and the buyer consents to the exclusive jurisdiction and venue of such courts.

Changes to Terms

Dodeca Domes reserves the right to modify, amend, or update these Terms of Service at any time. Any changes will be posted on this page with an updated effective date. The buyer's continued use of the products or services after such changes will constitute the buyer's acceptance of the new terms.

Effective Date

In Short

You are buying permission to build one dome.
You will own the physical dome that you build, and may use it for personal or commercial use.
You will not own the design of the dome, which includes the design of the hubs, the plans and the drawings.
You are not allowed to reproduce, sell, publish, share, or distribute any part of the design.
You are responsible for ensuring the dome is safe and up to code.
Dodeca Domes is not liable if anything goes wrong during construction or during use.
All sales are final, and no refunds are offered.
